Under the law in Georgia, as long as you are less than 50 percent at fault, you can recover. So let’s imagine a jury came back with a 100 thousand dollar verdict. That’s what your damages were. But the jury found that you were 49 percent at fault and that the other party, the defendant you sue, was 51 percent at fault. Then you would recover fifty one thousand dollars. You would get 51 percent of the damages because forty nine percent of it was your fault.
