What Should I Do If I Was Injured by a Defective Product?

Each year, tens of thousands of products hit the marketplace. From vehicles to toys to medical devices to workplace equipment and numerous others, new products are being rolled out continually.

For the makers of these products, there is the hope of producing a successful offering that will be a hit with consumers and make them a lot of money. For consumers, there is the excitement trying out something new or the promise that the product will allow them to perform a task more efficiently or solve a major problem in their lives.

With an eye on maximizing profit and beating out their competitors, many product makers rush an item to market without going through the proper procedures to ensure that it is safe. And as a result, countless numbers of consumers get seriously injured by defective or dangerous products each year.

If a product has caused injury to you or a loved one, you might not think there is much you can do about it. Injuries like these happen all the time, and your first thought might be to just deal with the situation and move on. This could be a mistake, however, because there is a possibility of recovering compensation for your losses through a product liability claim.

At the very minimum, it never hurts to least talk with an experienced product liability lawyer about your case. Most injury lawyers provide free initial consultations, so all you have to lose is a little bit of your time in order to find out whether or not you have a viable claim.

Types of Product Liability Claims

There are three main types of product defects that may form the basis for an injury claim:

  • Design Defects: These are defects that occur because of an inherent flaw in the design of the product.
  • Manufacturing Defects: In some cases, there is no problem with the design, but there is a flaw in the manufacturing process that creates a hazard when consumers use the product.
  • Instruction or Warning Defects: Sometimes, the design and manufacturing processes are fine, but the product comes with certain dangers that consumers need to be warned about. Failure to provide proper instructions for use and/or proper warnings could be another reason for a product liability claim.

There are a couple different legal theories under which an injured plaintiff could file a product liability claim:

  • Negligence: When a product liability claim is filed on the basis of negligence, it means that the product manufacturer breached a duty of care that was owed to the injured consumer, that this breach was the cause of the injury, and that the consumer sustained compensable losses as a direct result.
  • Strict Liability: Regardless of a manufacturer’s duty of care, they are strictly liable for any product defects that result from the manufacturing process. So, if an injury occurred because of a defect that resulted from a manufacturing error, the plaintiff can recover damages without having to prove negligence.

Steps to Take After Being Injured by a Defective Product

Here are some important things to do when someone is injured by a defective product:

  • Seek Medical Care: As with any type of injury, the top priority is to make sure you get medical attention right away. Even if you do not think the injuries are all that serious, you should still err on the safe side and get checked out. Also make sure you follow the recommendations of the medical professionals that you see. This will help ensure that you can recover faster, and it will show the defendant that you are doing all you can to treat your injury.
  • Compile Documentation of the Injury: Gather as much evidence as you can about the injury and how it happened. Hold onto the product that caused the injury, even if it is broken and in several pieces. In some instances, the police may need to take the product as evidence. Take multiple photos of the product, your injuries, and where it happened. And if there are any individuals who saw what happened, retain their contact information so they can be called in later as witnesses if needed.
  • Create your Own Injury Report: While everything is fresh in your mind, it is a good idea to create your own report about what happened. Write out your report in as much detail as possible, or if you have a hard time writing, create an audio report using the voice recorder function in your smartphone.
  • Get in Touch with An Experienced Attorney: As we talked about earlier, you have nothing to lose by speaking with a seasoned product liability attorney about your case. Do this as soon as you can, so they can get started immediately on your claim.
