Georgia Truck Accident Injury Attorneys

Even more terrifying than a traditional car accident involving a passenger vehicle is a motor vehicle accident that involves a large truck. Driving around large trucks can be nerve-racking and being involved in an accident with one can be downright horrifying. What’s more, large truck accidents almost always leave the occupants of the smaller vehicle involved with severe injuries.

Often, truck accidents are fatal. If you were to inspect the city of Atlanta on a map or if you’ve ever driven through here, you may know that Atlanta is at the junction of several Interstate highways feeding the entire Southeastern United States. Millions of dollars and millions of tons of goods flow through Atlanta and surrounding suburbs every day. These goods are transported by large trucks, often guided by well trained truck drivers.

On occasion, however, these trucks malfunction or a driver pushes his/her limits, putting other Atlanta drivers at risk. At the law offices of Bailey, Javins, & Carter L.C., our lawyers know that a truck accident can change your life. If you have suffered serious injuries in a truck accident in Atlanta, or if you have lost a loved one in a truck accident, our lawyers can represent you in your claim for damages. Call us today to learn how we can help.

Most Common Truck Accident Injuries

Large trucks can weigh up to 80,000 pounds – that’s about 20 times more than the average passenger car. The more weight that is involved in the accident, the more force that’s involved, too. The greater the force involved, the more significant the damages that result. Our lawyers have helped victims of truck accidents who have suffered serious injuries. Some of the most common truck accident injuries we’ve seen over the years include:

  • Crush and amputation injuries. A vehicle may be completely totaled in a truck accident, which means that whoever is inside the vehicle at the time of impact may be a victim of a crush injury or another severe injury that results in the loss of viability of a limb. Crush and other tragic injuries often result in amputations.
  • Neck, head, and brain injuries. The neck, head, and brain are often impacted with large amounts of force in a crash, either as a result of snapping back and forth quickly (whiplash), as a result of being hit with an object, or as a result of penetration. The neck may sustain soft tissue injuries, the head external bleeding and lacerations, and the brain a traumatic brain injury (TBI).
  • Injuries to extremities. A person’s limbs are often severely impacted in a crash, leaving the victim with soft tissue injuries (such as sprains and strains and ligament tears) or bone fracture injuries. In addition, bruises, cuts, and lacerations are all common as well.
  • Spinal cord injuries. The spinal cord is one of the body’s most vital components, and yet also one of the most delicate. While protected by the spinal column, if enough force is involved, the spinal cord could be impacted, resulting in paralysis.
  • Internal injuries. Enough force pressing down on a person could result in an internal injury, as could being hit with an object or penetrated with a sharp object. Sometimes, bone breaks within the body, such as a broken rib, will also lead to organ-penetrating injuries. One of the biggest concerns of internal injuries is internal bleeding which, if left unchecked, can be fatal.

If you have suffered any of the serious injury types listed above or any other injury, our lawyers can help you get the medical treatment you need and the compensation you deserve.

Truck Accident Injuries: Expensive and Devastating

Truck accident injuries aren’t just incredibly painful and scary, but also expensive and emotionally and physically devastating, too. To be sure, a person who is involved in a truck accident will face costs for:

  • Hospital transportation (ambulance, helicopter);
  • Hospital stay;
  • Surgeries;
  • Medications;
  • Treatment and therapy;
  • Doctors’ visits;
  • Anesthesia; and
  • More.

This is in addition to any property damage costs the victim incurs. What’s more, because truck accident injuries are usually very serious, it is very unlikely that the victim will be able to return to work anytime soon. This means that in addition to the financial burdens listed above, the individual will also suffer the financial strain of lost wages. And that’s not all – truck accident injuries are disabling. This means that the individual may not only be unable to do the things they love, like golf or jogging or playing with their kids, but they may not even be mobile at all. Sometimes, disabilities are permanent. Serious disabilities can give way to psychological disorders, like depression.

Who Pays for Truck Accident Injuries?

If you’ve been in a truck accident and have been seriously injured, you may be looking at tens of thousands–or even hundreds of thousands–of dollars’ worth of economic losses. And that doesn’t even include the value of the non-economic losses you’ve suffered! You deserve to be compensated. In Georgia, drivers who cause accidents are responsible for paying for them. This means that if you did not cause the truck accident through fault of your own, you may be able to bring a claim against:

  • The truck driver;
  • The trucking company;
  • The shipper or loader of cargo;
  • The truck manufacturer; or
  • Any other third party whose negligence was to blame for your accident.

Keep in mind that even if the accident was the fault of the truck driver, you’ll probably bring a claim against the trucking company due to the theory of vicarious liability. In order to ensure that your right to seek damages is preserved, you must bring forth your claim within two years from the date of your accident. Waiting longer than two years to file a civil action is a bar to recovery in Georgia.
